Terms of Use

Welcome to MySouthampton student app (the “App”).
Please read these Terms of Use carefully before using the App, as they contain important information about how you may use this App.
1. The terms on which you may use this App
1.1 These Terms of Use (together with the other documents referred to in paragraph 1.3) set out the terms on which you may use our App.
1.2 By accessing or using the App, you confirm that you accept and agree to abide by these Terms of Use. If you do not agree to these Terms of Use, you may not use the App and should stop using the App immediately.
1.3 The following policies also apply to your use of the App:
- •1.3.1 Our Privacy Policy By accepting these Terms of Use you are consenting to us processing any personal data that you provide to us or that we collect from you as a result of your use of the App.
- •1.3.2 Our Cookies Policy.
1.4 The App is primarily intended for use by current students of University of Southampton (Undergraduates and Postgraduate Taught Students) at our UK campuses. By using the App, you confirm that you are a registered student of the university and are at least 18 years old.
1.5 If you are under 18 years of age, you confirm that, prior to using the App, you have reviewed these Terms of Use with your parent or guardian and that you and your parent or guardian understand its terms and conditions and agree to them.
1.6 The App may also be used by staff and postgraduate research students holding a current University of Southampton IT account.
2. Access and Security
2.1 You are required to sign in with your University-provided User ID to access the App. You are responsible for maintaining the confidentiality of your login credentials and for all activities that occur under your University account.
2.2 If you think that somebody else might know your user identification code, password then you must let us know by emailing us using the contact details below as soon as possible.
2.3 We reserve the right to disable any user identification code, password and/or security verification credentials and/or your access to the App at any time if, in our reasonable opinion, you fail to comply with any of these Terms of Use, if we consider that you are using the App to download content or infringe in any manner the rights of another person or if we consider that there may be a security risk.
3. Permitted Use
3.1 The App is provided for educational, informational, and administrative purposes to support your academic journey at University of Southampton.
3.2 You may only use the App for lawful purposes and in compliance with all applicable laws, including without limitation data protection and privacy laws, and laws relating to copyright of content.
3.3 You agree not to:
- •3.3.1 use the App for unlawful or unauthorised purposes or in an unlawful or unauthorised manner;
- •3.3.2 share your access credentials with others or attempt to access another user’s account;
- •3.3.3 upload or distribute content that is offensive, defamatory, or violates the rights of others;
- •3.3.4 attempt to gain unauthorised access to the App, the server, equipment or network on which the App is stored, any server, computer or database connected to the App or any software; or
- •3.3.5 use the App to post content or link to content where you know that or ought to have known that the owner of that content has not consented to or authorised that posting or linking or where that posting or linking infringes the rights of that owner or any other third party.
3.4 If you breach any term of these Terms of Use your right to use the App will immediately end. In addition we may take such other actions including, without limitation, legal action as we consider appropriate.
3.5 If you breach any term of these Terms of Use, or if we receive a request from a law enforcement authority to do so, we may report your identity, details of any breach and any other information we consider necessary to relevant law enforcement authorities.
4. Content and Intellectual Property
4.1 This App is made available to you free of charge.
4.2 We reserve the right to change the App and the content on it, including without limitation by adding or removing content or functionality, at any time.
4.3 We regularly review the content on the App. However, we cannot guarantee that all content on the App is accurate, complete or up to date.
4.4 We therefore make no warranties, representations, undertakings or guarantees that:
- •4.4.1 the content on our App is accurate, complete or up to date;
- •4.4.2 our App or any content on it will be free from errors or omissions; and/or
- •4.4.3 our App is secure or free from bugs or viruses. You are responsible for ensuring that the device from which you access our App has suitable anti-virus software in place.
4.5 All content provided within the App, including text, graphics, and software, is the property of University of Southampton. We, or our licensors, own the copyright and all other intellectual property rights throughout the world in the App and our website and all content on each of them other than content uploaded by or linked to by others.
4.6 You may not copy, modify, disassemble, de-compile, reverse engineer, merge, distribute or create derivative works from the App content without prior written consent from the University of Southampton, except to the extent that such actions cannot be prohibited by law.
4.7 You may download the content we own from the App and/or print a copy of any page on the App only to the extent consistent with the purposes for which they are made available to you.
4.8 If you use, download, print or reproduce content from the App in breach of these Terms of Use your right to use the App will immediately end and you must return to us or destroy (at our option) all digital and paper copies of the content that you have made.
4.9 Please back-up your content and data used in connection with the App, to protect yourself in case of problems with the App.
5.Links from our App to other websites
5.1 Our App may contain links to other websites, services and applications from time to time. These links are provided for your convenience. We have no control over, and no responsibility or liability to you for, those other websites, services, applications or their content. Your access to and use of such websites, services and applications will be governed by the terms and conditions of those websites (even where you may access them without being required to sign-in separately) and you agree to comply with such terms and conditions.
6. Privacy
6.1 The University of Southampton values your privacy and recognises the need to process the personal information we hold about you (your data) in a fair and lawful manner.
6.2 Your use of the App is subject to our Privacy Policy, which explains how we collect, use, and protect your personal data. It is important that you read this information carefully.
7. User-Generated Content and Usage Data
7.1 If you upload or share content on the App:
- •7.1.1 you confirm to us that you own any content which you upload via the App or, if you are not the owner, that you have the right to upload it;
- •7.1.2 you retain ownership of your content but for so long as that content remains, grant University of Southampton a world-wide, non-exclusive, royalty-free license to use, store, copy, perform, distribute, display and make available that content in connection with the provision of the App; and
- •7.1.3 you are responsible for ensuring that your content does not infringe on the rights of third parties or violate any laws; and
7.2 We reserve the right to remove any content that you have uploaded via the App at any time.
7.3 You will compensate us for any losses, liabilities, costs, expenses, claims or proceedings that we suffer or incur, or will suffer or incur, as a result of or in connection with any user-generated content and/or any breaches by you of your obligations or confirmations in this paragraph 7.
7.4 We are not responsible for, and make no warranties, representations, undertakings or guarantees in respect of, any content on the App which is uploaded by a user. Any view expressed by any user of the App is their view and not our view nor the view of our officers or employees.
7.5 We also reserve the right to disclose your identity to any person who claims that any content you have uploaded to the App infringes their intellectual property rights or their right to privacy or is defamatory.
7.6 We may create data, analyses, documentation, applications and programmes utilising information derived from your use of the App.
8. Report abuse
8.1 If you find any content which other users have uploaded to the App offensive or if you feel it violates our Terms of Use, please contact us immediately using the contact information in paragraph 13.
9 .Termination
University of Southampton reserves the right to suspend or terminate your access to the App if you violate these Terms of Use or if your student status changes.
10. Our Liability to you
10.1 Nothing in these Terms of Use limits or excludes our liability to you for:
- •10.1.1 death or personal injury resulting from negligence;
- •10.1.2 fraud or fraudulent misrepresentation; or
- •10.1.3 any other matter for which we are not permitted by law to exclude or limit our liability.
10.2 As these Terms of Use govern your access and use of the App, all warranties, conditions and other terms relating to the App and/or its content which would otherwise be implied by law (whether by statute, common law or otherwise) are excluded to the fullest extent permitted by law.
10.3 Subject to paragraph 10.1, we will not be liable to you for any loss or damage arising out of or in connection with your use of (or inability to use) the App or your use of or reliance upon any content on the App, whether in contract, tort (including without limitation negligence), misrepresentation, restitution, under statute or otherwise.
10.4 We are not responsible for events outside of our reasonable control.
11. Changes to Terms of Use
11.1 University of Southampton reserves the right to modify these Terms of Use at any time. Changes will be communicated through the App, and your continued use signifies acceptance of the updated terms.
11.2 We also make changes to our privacy policy and cookies policy from time to time, so you should also check these regularly to see whether any changes have been made.
12. Applicable law
12.1 These Terms of Use are governed by the law of England and Wales and the courts of England and Wales have non-exclusive jurisdiction to determine any dispute arising out of or in connection with them. If you are resident in Scotland you may also bring proceedings in Scotland and if you are resident in Northern Ireland you may also bring proceedings in Northern Ireland. As a consumer, you will benefit from any mandatory provisions of the law of the country in which you are resident. Nothing in these Terms of Use affects your rights as a consumer to rely on such mandatory provisions of local law.
12.2 If a court finds a part of these Terms of Use to be illegal, the rest will continue in force. Each of the paragraphs of these Terms of Use operate separately. If any court or relevant authority decided that any of them are unlawful, the remaining paragraphs will remain in full force and effect.
